PRIVACY AND SECURITY POLICY

Because Conclusive Marketing (CM) is a fully integrated provider of marketing, customer list management, creative design and data services, we insist on providing our clients the highest level of privacy and security with regard to both your personal information and the list/creative data you submit to us for processing.  This Privacy and Security Policy is applicable to all our products and services.   

When you visit our web site(s), you can expect to be notified of:

1.      What personally identifiable information of yours is collected from you through the web site

2.      How the information is used

3.  With whom the information may be shared

4.  What choices are available to you regarding collection, use and distribution of the information

5.  The kind of security procedures that are in place to protect the loss, misuse or alteration of information under our control

6.  How you can correct any inaccuracies in the information

Our Commitment to Privacy and Security

All sensitive data transmitted to CM via our website(s) is encrypted using Secured Socket Layers (SSL). Secure Socket Layers is an Internet standard encryption method used to protect the confidentiality of data, data integrity, and authenticity of the sender and the receiver.

We also recommend that your data or list files be compressed (but not password protected) to add another layer of protection to your data. By doing this you are adding an additional means of identifying any data corruption that may occur during transmission.

Your Account Information

We require that you have contact and billing information on file to use our services, whether the service is fee-based or not. This account information is stored on site and protected with a user name and password of your choice. This account information may be submitted via web based form, or telephone to our Customer Service Representatives. 

When you open an account with us, we request your name, email address, phone/fax number, postal address, ZIP Code, state, and country. We use this data to manage registrations, and, when you place an order, to contact you about your order and to print your return address on direct mail pieces as appropriate.  You may change this data at any time by entering the Account Management sections of our websites.

In some cases we may use your email address, mailing address and/or phone/fax number to contact you to send the CM newsletter, product bulletins, marketing materials, and other notifications to the address you provide. You may request that this not be sent to you by simply contacting Customer Service at 800-346-0073.

Your Payment Information

In order to take payment for your order, we collect credit card information from you. To maintain the highest level of security, your credit card information is encrypted using secure socket layer technology. SSL is secure server software that protects against any unauthorized access.  CM uses your credit card information for the sole purpose of accepting payment for your order.

 

Third Party Customer Information and Your Private Library Data

As part of any number of our services, you may be uploading customer and sales prospect lists, as well as, marketing communications creative materials and documents to us for processing.  CM understands that full ownership of the data files and creative materials provided by our clients will remain the exclusive property, including all rights thereof, of the rightful owners of such data and materials. We agree to process the data provided by our clients, for the sole purpose of providing them with market campaign, data processing and list management services.  CM agrees not to use said data for any additional purpose, unless authorized in writing by the company submitting the data, and also agrees not to disclose your customer’s data to any other organization or individual in any manner that would be outside of the scope of the requested services.

CM offers, as a convenience to our clients, the opportunity to store its customer lists, creative libraries, and customer transaction history in private, password-protected files on CM servers to be used by the client for future marketing campaigns.  These lists and libraries are fully accessible to the client at any time for addition or deletion, as the client requires. 

Where a client has elected not to establish private libraries to store its data on CM servers, CM will after the completion of an order, purge this data from its secure servers.

Surveys

From time-to-time our site requests information from users via surveys.  Participation in these surveys is completely voluntary and the user therefore has a choice whether or not to disclose this information.  Information requested may include contact and demographic/product preference information.  Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.  Survey responses will only be used in the aggregate and never linked to an individual.

Sharing of Information with our Third Party Partners

We may occasionally have a marketing partnership with another company, where a portion or version of our web site is integrated into our partner's web site or product.  In these circumstances, we are jointly presenting our web site with our partner, and because the partner is referring customers to CM, we may agree to share information with that partner (and only that partner) as part of our formal contract with them. Where CM and a partner jointly promote our products and services, we may provide to the partner customer’s name and address.  Particular information about our partners’ privacy policies can generally be viewed on their own websites.   It is CM’s policy to not knowingly enter into any partnerships with companies who do not adhere to high standards of privacy and information security.  If you should encounter privacy or information security problems with one of our partners, please contact us at customerservice@conclusivemarketing.com .

Website Log Files

As with most every web site, CM records certain internet tracing information any time someone visits our site. We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use.  For every web page that is viewed, our web server records an IP address, the operating system, browser version and the name of the page that was viewed.

 

Cookies

 

A cookie is a piece of data placed on the user’s hard drive.  Usage of a cookie is in no way linked to any personally identifiable information while on our site.  For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site.  If a user rejects the cookie, areas of the site that are informational in nature may be accessible.  Areas of the site requiring a log-on will not be accessible without a cookie.  Cookies can also enable us to track and target the interests of our users to enhance the experience on our site.  Some of our business partners use cookies on our site.  However, we have no access to or control over these cookies.

Choice/Opt-out

We do not send the users of our service any unsolicited mail if they have requested to be removed from our contact list. We only send notifications of product updates, etc., if a user has specifically requested this information.  Our users are given the opportunity to ‘opt-out’ of having their information used for purposes not directly related to our site via email message to customerservice@conclusivemarketing.com .

Users who no longer wish to receive our newsletter or promotional materials from our partners may opt-out of receiving these communications by replying to unsubscribe in the subject line in the email or email us at customerservice@conclusivemarketing.com .

Keeping Your Information Secure

The most important step in keeping your information secure is to keep your password secure.  Do not give your password to other people and avoid choosing "easily guessed" passwords. Change your password immediately if you suspect someone has been accessing your account without your permission.   If for any reason you suspect a security violation has occurred, please immediately send an email to customerservice@conclusivemarketing.com .

Your Consent

CM may, in certain circumstances disclose or release information when we, in good faith, believe that it is necessary to (i) comply with the law, (ii) enforce or apply the terms of any of our user agreements, or (iii) protect the rights, property or safety of CM, our users, or others. By using our website, products and services, you consent to the collection and use of information by us as described in this Privacy Policy.  Changes to our policy will be posted here so you will always know what information we gather, how we use it and under what circumstances we disclose it.

This web site contains links to other sites. Please be aware that CM is not responsible for the privacy practices of such other sites.  We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information.  Please note that any information you post to a public bulletin board or chat room is available to all persons accessing that site.

Security

This website takes every precaution to protect our users’ information.  When users submit sensitive information via the website, your information is protected both online and off-line.

In cases where our registration/order form asks users to enter sensitive information (such as credit card number and/or social security number), the information is encrypted and is protected with SSL, 128-bit encryption.  While on a secure page, such as our order form, the lock icon on the bottom of Web browsers becomes locked, as opposed to un-locked, or open, when you are just ‘surfing’. 

While we use SSL encryption to protect sensitive information online, we also make best reasonable efforts to protect user-information off-line.  All of our users’ information, not just the sensitive information mentioned above, is restricted in our offices.  Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information.  Furthermore, ALL employees are kept up-to-date on our security and privacy practices.  Any time new policies are added or current policies changed, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our customers’ information is protected.  Finally, the servers that we store personally identifiable information on are kept in a secure environment.

Site and Service Updates

At times, we will send our clients site and service announcement updates. Clients are not able to un-subscribe from service announcements, which contain important information about our service. We communicate with the user to provide requested services and account information via email, phone/fax, or direct mail.

 

Correction/Updating Personal Information:

If a user’s personally identifiable information changes (such as your zip code), or if a user no longer desires our service, we will endeavor to provide a way to correct or update that user’s personal data provided to us.  This can usually be done at the Account Management page or by emailing our Customer Support. 

Notification of Changes

If we change our privacy policy, those changes will be posted and dated in this policy, so our users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it.  If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we would notify users by way of an email.  Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.
